Terms and conditions of commissioning and reproduction of images from Izzy White Photography

Definitions

• “The photographer” - Izzy White from ‘Izzy White Photography’

• “Client” - the person or organisation who the invoice is addressed to, and who enters into a contract for the sale of goods or provision or services by the Photographer.

All contracts and transactions between Izzy White Photography and the Client, either written or verbal, are subject to these terms and conditions. They shall be deemed to be incorporated into any contract between the Photographer and all of its Clients. Payment of booking fees means the Client is agreeing to these terms and conditions.

In accordance with the Copyright, Designs & Patents Act 1988, the copyright of all images created are owned by Izzy White Photography, unless written authorisation is given. All photographic prints, duplications or copies made by the Client shall be for the Clients personal use only, unless the Photographer gives written permission.

If a booking is cancelled by the Client within 24 hours of the arranged starting time, the Photographer reserves the right to charge the non-refundable booking fee for the assignment. If a booking is cancelled before 24 hours of the arranged starting time, the Photographer will offer a re-shoot on a mutually convenient date and time.

If the booking has to be cancelled or postponed due to weather conditions or other situations out of the Client or Photographers control such as horse lameness or illness, the Photographer will aim to offer a re-shoot on a mutually convenient date and time.

A non-refundable payment (booking fee) is payable at the time of booking by bank transfer- details will be given on request. This booking fee confirms the agreed date and time of the assignment. A non-refundable, full payment is required at the time of ordering for any additional images, either digital or prints. Izzy White Photography reserves the right to retain all the of the Clients materials in her possession until all payment owed has been paid in full.

All prices quoted to the Client apply only to the original booking request and any specifications given to Izzy White Photography by the Client. Izzy White Photography reserves the right to make additional charges for fees and expenses should these descriptions or specifications change or differ before or during the assignment. The Photographer will aim to provide indication of what these charges will be as soon as possible.

The Client shall be responsible for the behaviour of any persons or animals accompanying thing them to the assignment. The Photographer reserves the right to terminate any assignment without notice if she deems the Clients behaviour be unruly or unsafe. In these situations, the Photographer reserves the right to charge full expenses and fees. The Client will reimburse Izzy White Photography or her agents in full for any loss/ damage they cause to equipment or property.

There is no additional charge for travel within Hertfordshire. Distances out of this area are charged at 40p per mile. All assignment locations must be confirmed at least 1 week before the assignment is due to take place.

 

The Photographer is not responsible for any damage or injury incurred during any assignment, and she cannot guarantee the quality or quantity of images provided. In the event that images are not available due to unforeseen circumstances, a refund or re-shoot at a mutually convenient date and time will be offered.

The Photographer is not responsible for loss or damages incurred during shipping or delivery of USB’s or prints.

Izzy White Photography reserves the right to make reproduction of images created during assignments for marketing, promotional, competition and editorial purposes. Where under 16’s are present, a model release form will be requested from the parent or guardian in advance.

The photographer will not be liable for any delay of the supply of products or services that are beyond her reasonable control. The Photographer shall aim to meet agreed deadlines where applicable.

Izzy White Photography reserves the right to amend both Prices and these Terms and Conditions.
